The data to be processed. Objectives of personal data processing
The Administrator processes the data provided by you with reference of your application for a vacancy, aimed at checking your professional suitability for this position (or, if necessary, for other vacant positions in our company) and to carry out the procedure of applying for a vacant job position.
From a legal perspective, we rely on Article 6, paragraph 1 of the General Data Protection Regulations (DSGVO/GDPR) to process your personal data during the process of applying for a vacant job position. This provision allows data processing if it is necessary to enter into a contractual relation. If the need for data arises after the application process is completed, data processing matters are guarded by the provisions of Article 6 of the General Data Protection Regulations (DSGVO/GDPR), in particular, respecting the legitimate interests in accordance with Article 6, paragraph 1, sub-paragraph (f) of the General Data Protection Regulations (DSGVO/GDPR).
In case of refusal of any of the parties to cooperate, the data of applying candidates will be deleted after 6 months. If as a result of filing an application, you have entered into an employment contract, your data from the data system on vacant job positions will be transferred to our information system on personnel.
After your application for a vacant job position is received, the data will be reviewed by the HR department. Appropriate statements then navigate inside the company to the person responsible for the relevant vacant position. Further actions are then determined. Access to your data is fundamentally available only to those persons in the company who need it to proceed with processing of an application for a vacant job position and to adopt a decision on future employment.
The data are being processed in a computing machine centre in Switzerland, located at Finkenhubelweg 16, 3012 Bern, Switzerland, as well as in Ukraine, located at 04075, 30-А Lesnaya st., Puscha-Voditsa, Kyiv, Ukraine. The Administrator has concluded a data processing contract with the administrator of the computing centre, that processes personal data. By decision of the EU Commission, Switzerland has an adequate level of data protection.
Rights conferred to you as a data subject
You have the right to gain information on those personal data of yours that we process. When we receive a request for such information, other than in writing, we will require you to prove to be the person whom you claim to be; and hereby we hope for your understanding. You also have the right to adjust, discontinue or limit data processing to the extent as is provided by your legal right to do so. In addition, you have the right to object to processing in accordance with legal requirements. The same applies to the right to transfer data.
Moreover, pursuant to Article 8 of the Law of Ukraine “On Personal Data Protection”, you have the following rights:
1) to know the sources of collection and location of your personal data, the purpose of their being processed, the location or residence (permanent or temporary) of the owner or the administrator of personal data or to give a corresponding instruction to obtain this information to authorized persons, except to the extent required by law;
2) to receive information about the conditions for granting access to personal data, in particular information about third parties your personal data are being transferred to;
3) to have an access to your personal data;
4) on or before the 30th calendar day from the date of the relevant request receipt, to receive an answer as to whether your personal data are processed and to receive the content of such personal data, except to the extent required by law;
5) to file to the owner of personal data a motivated refusal against the processing of your personal data;
6) to file a motivated request for the modification or destruction of your personal data by any owner or administrator of personal data, if these data are processed illegally or are unreliable;
7) to protect your personal data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, failure to provide or untimely provision thereof, as well as protection from providing information that is unreliable or defamatory of honour, dignity and business reputation of an individual;
8) to file claims about the processing of your personal data to the Commissioner or to the court;
9) to apply remedies in case the legislation on personal data protection is being violated;
10) to submit a cautionary statement regarding the restriction of the right to process your personal data at the time of granting the consent;
11) to withdraw consent to personal data being processed;
12) to know the mechanism of automatic processing of personal data;
13) to be protected against an automated solution having legal implications towards you.
You have the right to file a claim against our Company to the data protection supervisory authority, as well as to the judicial authorities, regarding the personal data being processed by us, pursuant to the current legislation of Ukraine.
